The Resort Municipality of Whistler (“Whistler”) requested an interim stay of BC Rail’s pesticide use permit no. 134-123-00/02 pending a decision on the merits of an appeal. The Board found that there was no evidence before the Board that a short interim stay pending a decision would unduly prejudice BC Rail. The Board granted an interim stay, effective until midnight on Friday, September 8, 2000.
