The Appellants applied for a stay of the Respondent’s decision to issue an Approval to the Greater Vancouver Regional District (“GVRD”) to discharge biosolids to a ranch adjacent to the Ashcroft Manor & Teahouse. The Appellants requested a stay of the approval, pending the disposition of the appeal.
The Board found that the Appellants had failed to demonstrate that there would be irreparable harm would result to human health or the Appellants’ business interests if a stay was not granted. The Board also found that the balance of convenience in this case favoured denying the stay. The Board found that a stay would result in increased ranching costs to the GVRD, and would jeopardize its ability to continue a 5-year research project for which it had received significant federal funding. Accordingly, the application for a stay was denied.
