The appellants appealed a decision of the respondent refusing an application to capture two falcons. The appeal was a joint appeal since both appellants had been refused a license on the same grounds. Mr. Purshwitz was convicted in the Yukon for transferring a falcon without a license, and the Director then suspended him from applying for a permit for two years.
The Board found that the Director imposed the maximum sentence required by regulation. The Board found that the circumstances of the conviction were such that leniency was required in considering the suspension. It therefore sent the appeal back to the Director for reconsideration.
