PERMIT EXTENDED FOR ONE YEAR, APPEAL DISMISSED

    Summary

    Decision Date: March 12, 1990

Panel: G.W. Reed, Dr. R.F. Patterson, Dr. A.A. Larsen

The appellant appealed pesticide use permits issued to the respondent to apply Roundup, Tordon 101, and Tordon 10k along transmission lines from Mica Creek to the Adams River. The appellant had twenty grounds of appeal many of which had to do with the process of registering a pesticide. These grounds were dismissed as being beyond the jurisdiction of the Board to consider. The appellants other grounds of appeal dealt with the unreasonable adverse effects of the pesticide applications on the environment and human health. The appellant produced numerous studies from all over the world which linked the pesticides with disease in humans.

The Board dismissed the appeal finding that there would be no unreasonable adverse effects and that it can be applied in a safe and reasonable manner. The Board further held that the permitting process had been correctly carried out and the relevant legislation followed.
