    The appellant union appealed a pesticide use permit issued to B.C. Hydro. The appellant maintained that the pesticide Woodfume which Hydro was using to treat their hydro poles caused adverse effects on humans and wildlife. The appellant also maintained that Woodfume contained dioxin in concentrations carcinogenic to humans.

    The pesticide in question had been approved by the Federal Ministry of Agriculture.

    The Board held that the B.C. Court of Appeal has found the Board has no mandate to challenge pesticides approved by the Federal Ministry of Agriculture. The Board however could consider any adverse effects. It held that provided the pesticide was used according to the terms of the permit no unreasonable environmental impacts would occur.
