The appellants appealed 7 pesticide use permits issued to the Ministry of Forests. Their grounds for appeal were the same as found in decision 90/12. The appellants brought forward numerous grounds of evidence that the herbicide is toxic and poses a threat to humans and the environment. They asked the Board to consider alternative methods of treatment.
The Board determined that the real issue before it was whether or not the herbicide when used in accordance with the permit conditions would cause an unreasonable adverse effect on the environment. The Board found that there was not enough conclusive scientific evidence that would suggest any adverse effects. Accordingly it upheld all the permits.
