When Mr. Mohinder Singh Paul was granted a Conditional Water Licence allowing him to take water from Perry Homestead Brook, Mr. Bruno Giacomazzi appealed, fearing that the water use might damage fish habitat and result in water shortages. All parties agreed that for most years there was enough water for all licenses. In years where there wasn’t enough water the appellant’s earlier water rights would have precedence under the Water Act. The Board made recommendations on establishing a minimum flow required to support the brook’s fish population, water flow monitoring, water shortage procedures, and other matters. The appeal was dismissed.
