Mr. Terry Penner failed to pay a rental fee on his Conditional Water License for over three years, despite receiving 7 requests for payment. As a result the Deputy Comptroller cancelled the licence. The Board noted that the Water Act clearly allows a Conditional Water License to be cancelled if the licensee fails to pay rentals. The appeal was dismissed.
