    Mr. Vince, owner of Muskwa Safaris Ltd., was a guide outfitter. His quota for Stone sheep for 1993/94 was 19 sheep. Mr. Vince felt that the procedure used to allocate sheep to his guide outfitting business did not include all relevant factors and penalised him even though he had previously followed policy.

    Although there was some disagreement on the allocation process, Mr. Vince’s quota was allocated according to a Ministry policy. The policy recognised many factors and there was no evidence presented to show that the Deputy Director exercised his discretion improperly. Furthermore, a number of the issues raised (i.e., Aboriginal issues, packer/illegal guiding) were not within the jurisdiction of the Board. The appeal was dismissed.
